Terms of Service

1. Acceptance of Terms

By installing, accessing, or using TinyPoll ("the Service"), operated by TinyPoll (ABN 33 214 294 124) ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not use our Service.

These Terms apply to all users of TinyPoll, including workspace administrators, poll creators, and voters. They cover TinyPoll wherever you use it: the Slack app, and the web app at app.tinypoll.io.

2. Description of Service

TinyPoll is a Slack application that allows users to create and manage polls within Slack workspaces. The Service includes:

• Poll creation through the /tinypoll slash command
• Real-time voting and results display
• Poll management features (editing, closing, etc.)
• Anonymous and non-anonymous voting options
• Integration with Slack's messaging platform

The Web App (app.tinypoll.io):

TinyPoll also runs on the web at app.tinypoll.io. It is part of the same Service, on the same plan and these same Terms — there is nothing extra to buy and no separate account to create. It adds:

• Poll results that update live in your browser
• Voting, and creating polls that post to Slack as usual
• A list of the polls you own, and for workspace admins, every poll in the workspace
• Exporting a poll's results as a CSV file
• Plan, usage, and billing management for workspace admins

3. Service Plans and Pricing

Free Plan Includes:

• Up to 150 workspace members
• 20 polls per month
• Unlimited voting
• All core poll management features
• Real-time results and updates
• Anonymous and public voting options
• 7-day data retention
• Community support via email

Pro Plan (USD $0.33/user/month or USD $3.30/user/year):

• Everything in the Free plan
• Unlimited workspace members
• Unlimited polls per month
• 30-day data retention
• Priority support

Free Trial:

• When a workspace installs TinyPoll for the first time, it starts a 28-day Pro trial automatically. No card is required and nothing is charged.
• During the trial the workspace has every Pro feature, including unlimited polls, unlimited members, and 30-day data retention.
• When the trial ends, the workspace moves to the Free plan automatically. We never start a paid subscription unless a workspace admin chooses one through Stripe checkout.
• Free plan retention applies from the end of the trial: polls older than 7 days are deleted at the next scheduled cleanup, so export anything you need to keep before the trial ends.
• If the workspace has more than 150 members when the trial ends, the grace period described below begins.
• Each workspace gets one trial. Uninstalling and reinstalling TinyPoll does not start a new one.

Billing and Payment:

• All prices are in US Dollars (USD) and exclusive of applicable taxes. Australian customers may be charged GST. Other applicable local taxes may apply depending on your jurisdiction.
• Payments are processed securely by Stripe. TinyPoll does not store credit card details.
• Subscriptions renew automatically at the end of each billing period (monthly or annually) at the then-current rate, unless cancelled before renewal.
• Billing is per user. When you subscribe, the number of seats is set to the number of members in your Slack workspace at checkout. We then re-check your member count every day and update the seat count on your subscription to match — see Seat Counting below.
• You may choose monthly or annual billing. Annual billing includes a discount.
• Failed payments: If a payment fails, we will retry for 7 days. If payment remains unsuccessful, your subscription will be suspended. After 30 days of suspension, your subscription will be cancelled and your workspace will revert to the Free plan.

Seat Counting:

Workspace member counts are determined by querying the Slack API and exclude deleted users, bots, and guest accounts (single-channel and multi-channel guests). Seat counts are cached and may not reflect changes for up to 24 hours.

On a Pro subscription we reconcile seats once a day. If your member count has changed, we update the quantity on your Stripe subscription and Stripe prorates the difference for the rest of the billing period: adding members creates a prorated charge, and removing members creates a prorated credit. Both appear on your next invoice. Prorated credits are applied against future invoices and are not paid out as refunds.

Cancellation:

• A workspace admin may cancel the subscription at any time through the Stripe customer portal. Open it with /tinypoll plan in Slack, or from the Workspace page of the web app.
• Cancellation takes effect at the end of the current billing period. Until then, Pro features remain active; afterwards the workspace moves to the Free plan. If the workspace has more than 150 members at that point, the grace period described below begins.
• Cancelling does not delete your data. Once the subscription ends, polls are subject to the Free plan's retention period.

Refunds:

• New subscriptions: If Pro is not right for you, email support@tinypoll.io within 14 days of your first payment. We will cancel the subscription and refund that payment in full. This applies once per workspace, to the first payment of a new subscription, whether monthly or annual.
• Annual renewals: If an annual plan renews and you did not mean it to, email us within 14 days of the renewal charge and we will cancel and refund it in full.
• Monthly renewals: Monthly renewal charges are not refundable. You can cancel at any time before a renewal and keep Pro until the end of the period you have already paid for.
• Seat changes: Changes to your member count are prorated automatically as credits or charges on your next invoice (see Seat Counting). They are not refunded in cash.
• How refunds are paid: Refunds are processed by our team through Stripe, to the original payment method, normally within 10 business days of your request. We do not deduct payment-processing fees from a refund.
• Nothing in this section limits any refund or remedy you are entitled to under the Australian Consumer Law or any other law that cannot be excluded.

Grace Period for Workspaces Over the Free Limit:

• If your workspace exceeds 150 members on the Free plan, you will receive a 28-day grace period to upgrade or reduce your team size.
• During the grace period, all features remain fully functional.
• After 28 days, the workspace is limited to 5 new polls per calendar month until it upgrades or its member count falls below the limit.
• Existing polls remain visible and votable during any restriction period. Nothing is deleted because of the restriction; the Free plan's normal retention period continues to apply.
• If the workspace's member count falls to 150 or fewer at any time, the restriction is lifted and the grace period resets.

Enterprise Pricing:

For workspaces with custom requirements such as 99.9% uptime SLA, dedicated support, or volume pricing, enterprise plans are available. Contact us at enterprise@tinypoll.io for details.

4. User Responsibilities and Acceptable Use

Signing In to the Web App:

• You sign in either by following a TinyPoll link that Slack showed only to you, or with Sign in with Slack. There is no password to choose or lose.
• Links Slack shows only to you are personal. They sign in whoever opens them for up to 10 minutes, once. Don't forward them, paste them into a channel, or post them anywhere else.
• Sign out when you're finished on a device other people use. Signing out ends the session immediately, and you can end every session at once.
• Tell us at security@tinypoll.io if you think someone else has used your session.

You Agree To:

• Use TinyPoll in compliance with Slack's Terms of Service and Community Guidelines
• Only create polls that are appropriate for your workplace
• Respect other users' voting choices and privacy settings
• Not attempt to manipulate poll results or vote multiple times (where not permitted)
• Report any bugs or security issues responsibly
• Use the Service only for legitimate business or educational purposes

You Agree NOT To:

• Create polls with offensive, discriminatory, or inappropriate content
• Use TinyPoll for spam, harassment, or malicious purposes
• Attempt to reverse engineer, hack, or exploit the Service
• Create polls that violate local laws or regulations
• Use automated bots or scripts to create polls or votes
• Share poll results outside your Slack workspace without permission
• Use the Service to collect personal information from other users

5. Data Ownership and Usage Rights

Your Data:

• You retain ownership of all poll content you create
• You are responsible for the accuracy and legality of your poll content
• You are responsible for any personal information (PII) you include in poll questions or options
• You grant us permission to store and process poll data to provide the Service
• You can delete poll data at any time by uninstalling TinyPoll

Who Can Manage a Poll:

• The person who created a poll can edit, close, reopen, and delete it, and export its results from the web app.
• Workspace admins can manage any poll in their workspace — in Slack and in the web app — and can manage the plan and billing. Slack decides who is an admin (admin, owner, or primary owner); we simply read that.
• Everyone else in the workspace can vote in, and see the results of, the polls they can reach: polls in public channels, plus private channels they belong to.
• Anonymous polls stay anonymous. No one sees who voted — not the creator, not a workspace admin, and not in an exported file. We record that you voted so you can't vote twice, and never show who voted for what.

Our Data Practices:

• We automatically delete poll data based on your plan (Free: 7 days, Pro: 30 days)
• We don't claim ownership of your poll content
• We only use data as described in our Privacy Policy
• We don't sell your data, and share it only as our Privacy Policy describes

6. Service Availability and Support

Service Level:

• We strive for 99.9% uptime but make no guarantees of uninterrupted service
• Service availability may be affected by factors beyond our control
• Scheduled maintenance will be announced in advance when possible
• We provide best-effort support for all users
• Response times are targets, not guarantees
• Some features may have regional limitations

7. Installation and Permissions

To use TinyPoll, you must install it in your Slack workspace. Installation requires:

• Slack workspace administrator approval
• Granting specific Slack permissions (commands, chat:write, chat:write.public, channels:read, groups:read, im:write, team:read, users:read) — see our Privacy Policy for details on each
• Accepting Slack's third-party app terms

Signing in to the web app with Sign in with Slack asks you personally for the openid and profile scopes — never email. Installing TinyPoll does not grant them, and a workspace that installed TinyPoll before the web app existed does not need to reinstall.

You can uninstall TinyPoll at any time through your Slack workspace settings.

8. Limitation of Liability

Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any consumer rights or remedies that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any equivalent legislation in your jurisdiction.

What We're Not Responsible For:

• Loss of data due to user error or Slack outages
• Decisions made based on poll results
• Inappropriate poll content created by users
• Integration issues with Slack's platform
• Any damages exceeding the amount paid for the service

What We Are Responsible For:

• Providing the core polling functionality as described
• Protecting your data according to our Privacy Policy
• Responding to support requests in a timely manner
• Maintaining reasonable service availability

9. Intellectual Property

TinyPoll's Rights:

• TinyPoll name, logo, and branding are our trademarks
• The software code, architecture, and algorithms are our intellectual property
• We retain all rights to improve and modify the Service
• Documentation, user interfaces, and design elements are protected by copyright
• You may not reverse engineer, decompile, or attempt to derive source code
• Any suggestions or feedback you provide may be used without compensation

Your Rights:

• You retain all rights to poll content you create
• You grant us a limited license to process your content to provide the Service
• You can use TinyPoll according to these Terms during your subscription
• You can export your poll data before automatic deletion
• This license terminates when you stop using TinyPoll

10. Termination

You Can:

• Stop using TinyPoll at any time
• Uninstall TinyPoll from your Slack workspace
• Sign out of the web app, which ends that session immediately
• Request data deletion (processed within 30 days)

We May:

• Terminate access for violations of these Terms
• Suspend the Service for maintenance or security reasons
• Discontinue the Service with 30 days notice

Upon Termination:

• Active service data (polls, votes, settings) may remain subject to our normal retention schedule unless you request deletion, which we process within 30 days
• Billing records may be retained for up to 7 years as required by Australian tax law
• Security logs may be retained for a reasonable period for investigation purposes
• These Terms will remain in effect for past use
• You'll lose access to all polling data

11. Changes to Terms

We may update these Terms from time to time. When we do:

• We'll post the new Terms on this page
• We'll update the "Last updated" date
• For significant changes, we'll notify users via Slack
• Continued use after changes means you accept the new Terms

12. Governing Law and Disputes

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved through:

1. Good faith discussion — Contact us first and we'll try to resolve it informally within 30 days
2. Mediation — If informal resolution fails, either party may refer the dispute to mediation administered by the Resolution Institute (Australia)
3. Arbitration — If mediation fails, the dispute will be resolved by binding arbitration administered by the Resolution Institute, seated in Sydney, Australia

Nothing in this clause limits either party's right to seek urgent injunctive relief from a court of competent jurisdiction.

13. Slack Integration

TinyPoll is a third-party application that integrates with Slack. We are not affiliated with Slack Technologies, Inc. Your use of TinyPoll is also subject to:

• Slack's Terms of Service
• Slack's Privacy Policy
• Your workplace's Slack usage policies

14. International Use

TinyPoll can be used internationally, but:

• You're responsible for compliance with local laws
• Our service infrastructure is in Australia; some providers, including our email provider, process data elsewhere (see our Privacy Policy for details)
• Some features may not be available in all regions
• Support is provided in English

15. Force Majeure

We will not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to:

• Acts of God, natural disasters, or extreme weather events
• War, terrorism, civil unrest, or government actions
• Internet outages, cyber attacks, or infrastructure failures
• Third-party service provider outages (including AWS or Slack)
• Pandemic, epidemic, or public health emergencies

16. Indemnification

You agree to indemnify, defend, and hold harmless TinyPoll and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:

• Your use of TinyPoll in violation of these Terms
• Your poll content that infringes on third-party rights
• Your violation of any law or regulation
• Any false or misleading information you provide

17. General Provisions

• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
• Entire Agreement: These Terms, together with our Privacy Policy, Cookie Policy, and Data Processing Agreement, constitute the entire agreement between you and TinyPoll regarding the Service.
• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations in connection with a merger, acquisition, or sale of assets.
• Notices: We may send notices to you via Slack direct message, email (if provided), or by posting on our website.
